Riverside, CA (September 7, 2017)—A Riverside County judge has handed a victory to those who work to protect housing and other development  from regulatory cost increases.  The Building Industry Legal Defense Foundation (BILD) and Building Industry Association of Southern California, Riverside County Chapter (BIASC-RC) won their lawsuit to stop an illegal development fee from being imposed by the San Gorgonio Memorial Health Care District. 

The fee would have tacked on thousands of dollars to all new development in the area including residential, commercial, and institutional projects, like churches and schools.  Sample fees would have been $228,400 for a 100-unit subdivision, $92,050 for a small, 50-unit apartment complex, and $114,100 for a small, neighborhood strip center. 

BILD and BIASC-RC sued in May of 2015 to stop the fee claiming the Healthcare District had no legal authority to adopt development fees of any kind in any amount.  In addition, the lawsuit claimed that the fee failed to meet state law requirements, that the District was infringing on local municipalities’ police powers, and that the building plans the District was basing the fee on failed to undergo review under the California Environmental Quality Act. 

BIASC-RC and BILD were concerned not only for the damaging effect that the fee would have had on local development, but also for the potential effect that letting the District adopt the fee might have on other agencies.  “Special districts only have the powers the legislature gives them,” said BILD General Counsel, Shanda Beltran, “if you let one district ignore those limits and do whatever they want, soon you’ll have districts all over California adopting fees without any real power to do so.” 

After more than a year in court, Riverside County Judge Sharon Waters ruled that the Healthcare District acted unlawfully in adopting the fee and directed the District to cancel the fee.  BIASC and BILD’s outside lawyer, David Lanferman with Rutan & Tucker was pleased with the judgement and stated: “The Court’s decision in this case provides significant relief to the housing industry in Riverside County, and an important reminder that State law limits the power of agencies to create burdensome fees on new construction activity without clear constitutional and legislative authorization.” 

The building industry sued the Healthcare District only after more than a year of protracted discussions regarding the fee.  Said Bill Blankenship, Executive Officer of BIASC-RC about the results of the case and the lead up to it: “We are pleased with the eventual outcome; however, we are saddened that the local residents will shoulder the burden of a bad decision by the District’s Elected Board Members for a funding strategy for expanding the hospital that was outside their legal authority.  Even after it was made clear to them that the District had alternate options within their state-mandated powers, they still decided to pursue a funding option for that was clearly illegal and not within their authority.”

The Building Industry Association of Southern California, Inc. is sad to hear about the passing of President and chief executive officer of the California Building Industry Association, Dave Cogdill.

The Cogdill family issued the following statement after their father, former California State Senator Dave Cogdill, passed away from pancreatic cancer today at the age of 66.

“My dad was my hero and I strive to be half as good a man, father, and servant as he was. Stoic and reserved, he selflessly dedicated his life to his family and community. Throughout his life, he made such a difference in the lives of so many people. His legacy as a community leader, state lawmaker, and business executive will long be remembered by those who were privileged to know and work with him. While we mourn our beloved father, a man of faith who epitomized integrity, we take some comfort in the knowing that he is finally free from pain and suffering,” said David Cogdill, Jr.

Former Senator Dave Cogdill most recently served as the president and chief executive officer of the California Building Industry Association, a role he assumed in October 2013. Prior to this, Cogdill served as Stanislaus County Assessor from 2011 to 2013. After leaving the legislature, Cogdill also served as a Commissioner on the California Water Commission and as the Chairman of the Maddy Institute at Fresno State University.

Cogdill served as the California State Senate Republican Leader from 2008 - 2009. He was elected to represent the 14th District in 2006. Cogdill served as vice chair of the Public Safety, the Revenue and Taxation, and the Joint Legislative Audit Committees. He previously represented the 25th Assembly District for six years in the California State Assembly, where he was vice chair of the Committee on Rules and minority floor leader. As the former chair of the California State Legislature Rural Caucus, Cogdill collaborated with local leaders on many issues concerning rural residents, such as access to water, health care and quality education. He received numerous awards for his public service; in 2007 he was named Senate Small Business Legislator of the Year by the California Small Business Association.

For his exemplary service to the community and state during the California budget crisis in 2009, Dave Cogdill was awarded the prestigious Profile in Courage Award from the John F. Kennedy Library Foundation in 2010.

In 2010, the California National Guard gave him its second highest meritorious award, the California Medal of Merit.

Cogdill built a real estate appraisal business in Modesto, where he once served two terms on the Modesto City Council.

He is survived by his wife, Stephanie; his children, David Jr. and Meghan Merrell; and his grandchildren, Connor, Katie and Cooper.

HBC Design/Build Competition from Orange County Dept. of Education on Vimeo.

More than 150 high school students from across the region spent two days combing through blue prints, hammering together wood frames and running plumbing through scale-sized model homes as part of the HBC Home/Design Competition organized by the North Orange County ROP.

Eleven teams of students competed in the event held last week at Reliable Lumber in Huntington Beach. The competition was part of Building Industry Technology Academy, or BITA, a career pathway program in high schools that trains students for jobs in the construction industry.

Certified building inspectors served as judges, measuring teams’ projects by safety, cleanliness of worksites, durability of the model homes, and other factors.

The Building Industry Association of Southern California, Inc. (BIASC) Greater Sales and Marketing Council (GSMC) has completed a series of insightful Lunch and Learns this month at Playa Vista in Los Angeles, Westridge at Canyon Hills in Lake Elsinore, and Parasol Park at Great Park Neighborhoods in Irvine.

On April 12th, GSMC had their first of three Lunch and Learns at Playa Vista. The BIASC council toured the Brookfield Residential populated neighborhood after learning about the forward-thinking, game changing-changing community concept back in the 90’s that is thriving today as it nears completion.

The group learned about how it all began, where it is today, and why Bloomberg News, The Hollywood Reporter, and the LA Times are talking about Playa Vista. They also learned more about density, community connection, walkability, and the amenities that are associated with the neighborhood. BIA members were able to view the innovative home designs that are attracting tech and creative workers at the “Jewel,” “Cleo,” and “Mason” model homes.

GSMC’s second Lunch and Learn on April 19th was at Westridge at Canyon Hills in Lake Elsinore. The council toured the miles of rolling hills of the next great village of Canyon Hills, one of the preeminent master planned communities in the inland Empire, to view the “Overlook,” “Vantage,” “Aura,” “Starling,” and “Viewpoint” model homes.

The Lunch and Learn covered the Pardee Homes’ beginning stages and the growth of the community, how they overcame challenges and obstacles, the creative process and finding inspirations, and why Canyon Hills is the ideal living destination.

The final lunch and Learn took place on April 26th at Parasol Park at Great Park Neighborhoods in Irvine by FivePoint. GSMC members toured the scenic low maintenance neighborhood of high-style homes that connects neighbors through parks, pools, trails, and friendly atmosphere.

Event attendees were able to view “Amethyst” from The New Home Company, “Carlisle” and “Sterling” from TRI Pointe Homes, “Celadon” from William Lyon Homes, “Jade” from Pulte Homes, “Julep” from Shea Homes, and “Lanterns,” “Obsidian,” “Sommerset,” and “Windchime” from Lennar.

They learned about the overall vision of Parasol Park with Tom Martin from FivePoint, the inspiration behind the architectural style and design from David Ko with Angeleno Architects, and how installing green houses brings the community together with Meg Hiesinger, Ph.D. from The Ecology Center.

Clint Lorimore, Director of Government Affairs, and David Dazlich, Deputy Director of Government Affairs, will join the BIA Riverside Chapter staff and Adam Wood, Director of Government Affairs, will join BIA Orange County staff.

Clint Lorimore comes to BIASC with a strong track record of public service and dedication to the Southern California region. His service includes serving as the Deputy District Director for Governor Arnold Schwarzenegger, covering the counties of Riverside and San Bernardino, and as a Senior Field Representative to Assemblyman Russ Bogh.  He has worked on several political campaigns including Congressional, City Council, and Water Board races. He sits on several regional boards and volunteers with various local organizations including serving on the Regional Council for the Southern California Association of Governments (SCAG) as the District 4 representative.

David Dazlich comes to BIA from Denver, CO, bringing with him seven years of experience in public policy, industry advocacy and political campaigns. Dazlich has spent the past year working in government affairs and advocacy on behalf of the oil and gas industry. Dazlich has served as a Senior Legislative Aide in the offices of the Minority Leader, the Whip, and the Caucus Chair of the Colorado State House of Representatives. In this capacity, David worked on policy issues including construction defects, regulation of the oil and gas industry and rules on industrial hemp. He has also worked campaigns for candidates and initiatives at the local, state and federal levels in Colorado, New Jersey, Pennsylvania, Virginia, Louisiana, and California.

Adam Wood has joined the BIA Orange County staff with a legal background. Wood graduated from Southwestern Law School in 2011 with a Juris Doctorate degree. Wood was a Jesse Unruh Assembly Fellow in 2004/2005 and was a Legislative Director for the 72nd Assembly District in the California State Assembly. His past experience also includes an Account Management position at Curt Pringle and Associates, and a Permit Management position for Mobilitie LLC.

Twelve student teams from Southern California Youth Build divisions and North Orange Country ROP Building Industry Technology Academy (BITA) programs competed for the coveted Design/Build Competition champion title this past weekend in Huntington Beach. The event, now in its 28th year, was held at Reliable Wholesale Lumber in Huntington Beach on Saturday, April 8th and Sunday, April 9th.

The competition, coordinated by Building Industry Association of Southern California, Inc.’s (BIASC) Home Builders Committee (HBC), awarded first place to the team from La Habra High School and second place to the team from Anaheim High School. 

The competition’s mission is to bring tomorrow’s builders and today’s professionals together in a fast-paced, two-day build project that mimics the “real-world” pressures of inspections and deadlines while enforcing the values of safety, teamwork, and craftsmanship. The competition further facilitates opportunities to help high school students in the BITA program develop their career portfolio, participate in field trips at industry sites and network with local businesses. The four-year program, with the help and support of the building industry, is a service provided by the California Homebuilding Foundation (CHF).

The competition involves teams from local high schools and community colleges all competing to build their own structure. Recent years have brought a focus to Green designs, framing and construction techniques. Each school can sell their final product and retain the revenue to support their school’s program.

Meritage Homes Corporation, Scottsdale (NYSE:MTH) on Thursday announced the appointment of Phil Bodem to Southern California Division President and Christopher Ryan to Florida Division President.

Both appointments signal a growth strategy. Meritage said it was "deepening its commitment" to the Southern California region with Bodem's appointment and "intends to pursue growth strategies to increase its number of new communities in the division." The company said it has changed Ryan with "growing the company's presence in the Tampa, Bradenton and Sarasota areas."

A veteran in the home building industry, Bodem joins Meritage Homes with more than 26 years of experience in home building, including 15 years as a division president. The Building Industry Association of Southern California, Inc. (BIASC) and California Housing Foundation (CHF) joined forces to host the 2017 Celebrity Waiter event on March 10th at the Turnip Rose in Newport Beach.

The Celebrity Waiter event is a zany and fun charity dinner featured local building industry “celebrities” serving and entertaining their selected guests for the evening. Highlights from the evening included Shea Homes’ Bob Yoder as President Donald Trump and Brookfield’s Adrian Foley as Austin Powers.

The event benefited education programs such as the Building Industry Technology Academy (BITA)—a comprehensive, four-year high school trades program, providing students across California the training they need to enter the building workforce after graduation.

CHF as a foundation itself invests in the future of the homebuilding industry through endowments that provide college and graduate school scholarships and fund research on key public policy issues. CHF’s research organization, CIRB, compiles and publishes statewide construction and new home statistics.

Home builders who provided their customers with the best purchase and ownership experiences—according to surveyed home buyers—were recently honored in the 21st annual Eliant Homebuyers’ Choice Awards competition. The winning builders were chosen based on the results of more than 106,000 surveys which were administered to all recent home owners from over 156 major homebuilders across the U.S. MBK Homes is the recipient of the “The Eliant” award for the Best Overall Purchase and Ownership Experience from among multi-division builders. In addition, MBK Homes was honored with 21 awards including an unprecedented 11 First Place awards and 6 Second Place awards among all Medium-Volume builders.

New single-family home construction is far below demand, and while new-home prices in Riverside and San Bernardino counties are lower than other Southern California areas, costs are still difficult for many Inland residents to meet.

A recent draft report from California’s Department of Housing and Community Development outlined the statewide woes reflected in the Inland area.

New-home production statewide is far below projected needs – 80,000 homes annually for the last decade, with a projected need of 180,000 homes per year. The lack of supply and associated rising costs are shutting a broad variety of Californians out of the market.

The nation’s most populous state has the third-lowest home ownership rate among the 50 states and the lowest in California since the 1940s.

An effort to streamline homebuilding permits failed last year in the state Legislature. California Gov. Jerry Brown promised in his January budget message to attack the housing issue again with a bill package he said would cut red tape, fees and other hurdles affecting the industry.

Building Industry Association's Southern CaliforniaGovernment Affairs staff from Baldy View Chapter for San Bernardino County and the Riverside County Chapter of the Building Industry Association of Southern California spoke to members of the Orange County Register press in order to speak about the current state of the housing market and the building industry in Southern California.

Despite the challenges, developers are finding ways to get homes on the market.

The Imperial Hardware lofts project in downtown Riverside reflects a trend of younger buyers’ preferences toward townhouses in urban areas, with “walkability” for work and shopping, Garrison said.

The Ontario Ranch development in Ontario is a 13-square-mile, master-planned community that ultimately plans 46,000 new homes.

“It’s a finicky time for the industry,” Garrison said. “Homebuilders want to be in business in California. California and the communities need to set the conditions; if they set the conditions for it, we will be there to build.”

The Building Industry Association of Southern California, Inc.’s (BIASC) Director of Environmental Affairs, Mark Grey, Ph.D., celebrated his tenth year with the organization. Dr. Grey, who also works as the Technical Director for the Construction Industry Coalition on Water Quality (CICWQ), brings a wealth of knowledge to BIASC and CICWQ in the fields of water and air quality protection, having worked in environmental science for the past 30 years in the Pacific Northwest and California. Dr. Grey represents the interests of BIASC and CICWQ members in California, with an emphasis on water quality policy and regulatory matters.

“I work with our members and their consultants to understand complex water quality regulation and how we can do business within that structure,” Dr. Grey mentioned when asked about his role with BIASC. “And I spend a significant amount of time communicating the technical basis for our advocacy positions, in a number of different ways…many presentations in a variety of forums, writing and research report production, and regulatory workshops and proceedings among others.”

Before joining BIASC in April of 2006, Dr. Grey operated his own consulting firm and was the Director of Technical Services for Synagro Technologies, Inc., one of the nation’s largest private company involved in organic waste recycling. Dr. Grey is a certified professional soil scientist and is a member of the Soil Science Society of America. Dr. Grey holds a Ph.D. in Soil Chemistry and M.S. in Forest Ecosystem Analysis from the University of Washington in Seattle, WA and a B.A. in English from Eastern Washington University in Cheney, WA.

In February 2008, Dr. Grey was appointed to the state of California’s Storm Water Advisory Task Force that advises the State Water Board on program priorities, funding criteria, project selection, and interagency coordination of state programs that address storm water management. Dr. Grey is a trustee of the Southern California Water Committee and serves as a governing board member for the Council for Watershed Health.

Dr. Grey has an extensive teaching background, both during work at the University of Washington and in the past ten years for CICWQ and BIASC. Dr. Grey has also published peer-reviewed papers in the fields of water quality and atmospheric science.

When asked what he loves most about BIASC, Dr. Grey responded by speaking about how enjoys working with such great members of the organization. [I enjoy] “the super high caliber people who are our members, and the super high caliber people they work with to do business, especially in figuring out how to succeed and thrive within a complex regulatory and project approval structure that exists in California.  The professional quality of our members is really amazing and is a blessing for our industry as a whole, and it’s my job to get the best out of them so I can do the best job possible for BIA and others in the construction industry.”

Dr. Grey has been married to his wife, Amanda, who is the Environmental Programs Manager at the University of California, Riverside, since 2011.  They have a daughter Olivia, 16, who is a sophomore in high school who aspires to be a college softball player.
